Terms and Conditions

Welcome to the Sonogen Mobile Application (“Mobile App”), a companion to the Sonogen BGS Device (“Device”). These Terms and Conditions (“Terms”) govern your use of the Mobile App, the Sonogen Web Portal (“Web Portal”), and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, you must not use the Services.

1. Definitions

  • “Sonogen” refers to Sonogen Medical, Inc., the company providing the Services.
  • “User” or “You” refers to the person using the Mobile App, Device, or Web Portal.
  • “Caregiver” refers to individuals invited by Users to monitor treatment progress via the Web Portal.

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the Services. By using the Services, you represent and warrant that you meet these eligibility requirements.

3. Medical Disclaimer

The Sonogen Mobile Application and Web Portal are not substitutes for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider regarding your health condition. Use of the Mobile App, Device, and Web Portal is at your sole discretion and risk.

4. License to Use the Services

Sonogen grants you a limited, non-exclusive, non-transferable, and revocable license to:

  1. Use the Sonogen Mobile App as a companion to the Sonogen Device.
  2. Access your treatment progress via the Sonogen Web Portal.
  3. Invite Caregivers to monitor your progress on the Sonogen Web Portal.

This license is subject to compliance with these Terms.

5. User Responsibilities

You agree to:

  1. Use the Sonogen Mobile App and Sonogen Web Portal only for their intended purpose.
  2. Maintain the confidentiality of your Sonogen Web Portal login credentials.
  3. Ensure any data you input into the Sonogen Mobile App or Sonogen Web Portal is accurate and complete.

6. Caregiver Access

You may invite Caregivers to view your treatment progress via the Web Portal. By doing so:

  • You consent to sharing your treatment data with the invited Caregivers.
  • You acknowledge that Sonogen is not responsible for how Caregivers handle your information.

7. Data Privacy

Sonogen respects your privacy. By using the Services, you consent to the collection, use, and sharing of your information as described in our Privacy Policy. Key points include:

  • Data collected includes treatment information, device usage data, and app interactions.
  • Data may be used to improve the Services or for regulatory compliance.

8. Intellectual Property

All content, trademarks, and technology in the Sonogen Mobile App, Sonogen Web Portal, and Sonogen Device are owned or licensed by Sonogen Medical. You may not copy, modify, or distribute any aspect of the Services without prior written consent.

9. Prohibited Conduct

You may not:

  1. Use the Services for unlawful purposes.
  2. Reverse-engineer or tamper with the Sonogen Mobile App, Sonogen Web Portal, or Sonogen Device.
  3. Misrepresent your identity or health information.

10. Service Availability

Sonogen Medical strives to provide uninterrupted Services but does not guarantee availability. Maintenance, updates, or unforeseen circumstances may result in temporary interruptions.

11. Termination

Sonogen Medical may suspend or terminate your access to the Services if you violate these Terms or if your Device warranty period ends. Upon termination, you must cease all use of the Sonogen Mobile App and Sonogen Web Portal.

12. Limitation of Liability

To the maximum extent permitted by law:

  • Sonogen Medical is not liable for any indirect, incidental, or consequential damages arising from your use of the Services.
  • Total liability for any claim related to the Services will not exceed the amount paid for the Device.

13. Governing Law

These Terms are governed by the laws of the State of Delaware. Any disputes shall be resolved in the courts of the State of Delaware.

14. Changes to These Terms

Sonogen Medical may update these Terms from time to time. Changes will be effective upon posting on the Sonogen Mobile App or Sonogen Web Portal. Continued use of the Services constitutes acceptance of the updated Terms.
